The Divorce Process
An application can be made jointly by both parties or by one of the parties solely. If you are making the application solely, the other party will need to be served with the application and there is usually process server fees payable which vary depending on the location.
The parties will need to attend the hearing if there are children of the relationship under 18 years old and satisfy the Court that there are appropriate care arrangements in place for the children. If there are no children under 18 you will not need to attend a hearing and the Divorce Order will be made in chambers, without a need to appear in Court.
The timeframe for finalising your Divorce once filed with the Court will depend on the Court’s caseload. Usually, it is around 6 weeks or more. As of 1 July 2022 the filing fee for your Divorce application is $990. If you hold a concession card, you will be eligible for a reduced fee of $330.
